An absolute discharge may occur where the accused is found guilty or has pleaded guilty, but is deemed not to have been convicted of the criminal offence and no punishment or restrictions are placed upon them by the judge. Such a discharge cannot be given if the offence carries a minimum punishment, or is punishable for 14 years or greater.

The court takes no further action against an offender, but the offender’s discharge will appear on their criminal record.

Where a person has pleaded guilty or been convicted of an offence, in certain circumstances the court may, instead of imposing a sentence (and on summary complaint instead of convicting), discharge that person absolutely. No penalty is imposed, and in summary proceedings no conviction is recorded.
